Sinn Fein TD calls for 2012 Kilkenny stabbing incident to be re-examined

A Sinn Fein politician is calling for a review of a case in which a Laois man was stabbed to death in Kilkenny City, in 2012.

The matter weas raised yesterday in the dail as part of Topical Issues.

Kieran Monaghan of Durrow, Co. Laois died on February 15th 5 years ago following a single stab wound to the heart.

The incident was fully investigated and a file went to the DPP who directed that there would be no prosecution in the matter.

It was the first time the Criminal Law (Defence and Dwelling) Act 2011 has been applied.

TD Brian Stanley explained what he's looking for

"What I'm asking for is, look that the Gardai investigation needs to be re-examined, the conduct of the investigation needs to be re-examined, all of the evidence needs to be re-examined.

I think the most appropriate way of doing that is by a senior officer from outside the division, from outside the Kilkenny division re-examing this"

The Criminal Law (Defence and Dwelling) Act 2011 explained:

1. (1) In this Act

'act' includes omission and a reference to committing or doing an act includes a reference to making an omission;

'curtilage', in relation to a dwelling, means an area immediately surrounding or adjacent to the dwelling which is used in conjunction with the dwelling, other than any part of that area that is a public place;

'dwelling' includes:

(a) a building or structure (whether temporary or not) which is constructed or adapted for use as a dwelling and is being so used,

(b) a vehicle or vessel (whether mobile or not) which is constructed or adapted for use as a dwelling and is being so used, or

(c) a part of a dwelling;
